Covid-19 Update – 22 April 2020
We will post regular updates to our website and our facebook page.
Mott and Associates are committed to continuing to provide our exceptional legal services during this period. Our team take your and our team’s safety very seriously. We will continue to remain open as long as practical. We have put measures in place to work online and remotely. Until further notice attendance at our office is by appointment only. We ask if you are experiencing flu or cold symptoms please advise us and other options will be investigated.
Are you still conducting face to face appointments?
We are still conducting face to face appointments where necessary (wills, EPAs etc). We would however prefer these appointments are conducted by facetime, skype or zoom where possible. If it is required that you attend our office, we have put procedures in place to protect both yourselves and our staff.
What if I need to drop something off?
If you need to drop documents off to our office, please feel free to use our post box located at the back of our premises in the Cleveland House arcade (under the stairs to the second floor of Cleveland house). It is box number 17 and it is clearly marked as Mott and Associates as shown on the picture below.
How are we going to operate remotely or online?
We can use phone calls, skype, facetime and other methods to communicate remotely instead of face to face contact. Usually face to face contact is only required when we are validating your identification documents, signing wills or witnessing documents. We are working on various ways to ensure we meet the identity validation requirements during this period.
What if I have already booked an appointment?
If you already have an appointment booked, we will call you to schedule it for an earlier date. If that is not possible, we ask you to attend our office as soon as practicable to provide identification (if we have not already verified your identity). Once verification (if required) has been completed your scheduled appointment can be conducted by phone, facetime or skype.
What if we have a conveyancing matter? Can it still settle?
Mott and Associates are registered for PEXA. PEXA is an online tool for settling conveyancing matters. No face to face contact is required. If it is not possible to use PEXA (not all firms acting on the other side are registered), we will seek extensions or use various other techniques to ensure the transaction continues as scheduled.
I want to do a Will or Enduring Power of Attorney. Can I still do one?
Yes. In most instances we can take your initial instructions by skype or facetime. All you need is a mobile phone, computer or iPad and we can get what we need to ensure we can take your instructions. We have incorporated various methods to ensure your documents can be executed validly and will guide you through that process as necessary.

Due to lengthy court lists, court proceedings are best avoided, and we do all we can to ensure they are. There are many options to avoid court and we often find with a sensible approach the costs can be significantly reduced. There are however circumstances where agreement just cannot be reached, and proceedings are required to ensure your rights are protected. We are continuously reviewing agreements and leases for Aged Care facilities. Retirement Village agreements are complex and you need to ensure you understand the impact of the agreement being signed. We advise of what to look for in an Aged Care facility to ensure it meets your needs. Many people do not pay adequate attention to the agreements as they believe it will only be an issue for their estate. We find that clients often need to go into higher care facilities at some stage and this is often when they find out the agreement is an issue.
We will ensure you are adequately aware of how the agreement operates, what fees are charged and when, and ensure that you receive the maximum funds back should you be required to exit the facility.
